![]() | PURCHASE AGREEMENTThis Agreement contains the complete terms and conditions that apply to the purchase of the 3M products described on this site. As used in this Agreement “3M” means 3M Company, “3M PRODUCTS” means the 3M products listed on the order form and “BUYER” means the person ordering the 3M PRODUCTS. These terms and conditions are applicable for 3M PRODUCTS you purchase today through this site (eStore), and may be different from the terms and conditions of purchase for other 3M products you purchase through other websites—therefore, please carefully review these terms and conditions before purchase. Superseding EffectThese terms and conditions apply to all 3M business transactions conducted via this eStore. To the extent these terms and conditions of sale differ from those outlined in other agreements, including distributor agreements, these terms and conditions shall control. Purchases on the eStorePurchases on the online store may be made by credit card or p-card only, and only via online entry. The eStore does not currently support EDI or system-to-system transactions. Terms of payment are governed by the customer's agreement with the applicable credit card issuer. Products Available3M products may be added or removed from the eStore at any time without advance notice. The offer of 3M PRODUCTS for online sale in no way commits 3M to continue to offer the same items or format for sale in the future. Products for Buyer Use or Consumption Only3M eStore provides a BUYER with convenient on-line access to small quantities of a variety of 3M PRODUCTS. It is intended that BUYER is purchasing the products for its own use or consumption only. BUYER may not resell, distribute or transfer as part of commercial activity the 3M PRODUCTS purchased on the 3M eStore to any third party. The 3M PRODUCTS offered through the 3M eStore are intended for use in the 48 contiguous United States only. 3M Right To Limit Quantities Or Decline Sale3M reserves the right to limit sale or quantities of 3M PRODUCTS available through the eStore. 3M reserves the right to exercise its discretion to decline sale of any 3M PRODUCT, to a prospective purchaser. If 3M rejects the order, then 3M will notify the BUYER the order has been rejected. Sales TaxBecause 3M does business across the entire US, we are required to collect sales tax based on the purchase address. At this time, we cannot provide a method to handle tax-free sales. Transportation Policy3M PRODUCTS may be ordered from and for use in the continental United States only. 3M PRODUCTS purchased on the eStore will be delivered via UPS Ground or ground freight. Orders will have a standard charge added to them, depending on the total price of material ordered. e-Communications to Distributors3M PRODUCTS are available from many distributors throughout the United States. Unless you request otherwise, we will share your needs with an authorized distributor who may be able to service future orders with quantity pricing or delivery from local stock. Privacy3M will use the personal information a BUYER submits to process the order and serve the BUYER better. For more information on how 3M may use a BUYER’s personal information, see the privacy policy. Over/Under Shipping PolicyFor make-to-order/custom size items, it is 3M's policy to consider an order complete if 3M ships a quantity that is within 10% of the original quantity ordered. Return of Merchandise:a. In order to determine allowable return good eligibility, the timing of the eligibility is calculated between the 3M Ship Date and the Return Date. 3M Ship Date is the date the material shipped from 3M to the customer. Return Date is the date the material is physically received by 3M or a 3M authorized agency. b. Return of merchandise will be considered based on the reason for the return and the conditions below: 1. All returns must be pre-authorized by 3M. To obtain Return of Merchandise authorization call 3M eStore Customer Support at 1(800)234-8068.
Many factors beyond 3M’s control can affect the use and performance of a 3M PRODUCT in a particular application, including the conditions under which the product is used and the time and environmental conditions under which the 3M PRODUCT is expected to perform. Since these factors are uniquely within the BUYER’s knowledge and control, it is essential that the BUYER evaluate the 3M PRODUCT to determine whether it is fit for a particular purpose and suitable for the BUYER’s method of application. Warranty and Limited RemedyThe 3M PRODUCTS will meet 3M’s specifications at the time of shipment. 3M MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. If a 3M PRODUCT is defective, BUYER’s exclusive remedy and 3M’s sole obligation shall be, at 3M’s option, to replace the 3M PRODUCT or refund the purchase price. Limitation of Liability3M will not be liable for any loss or damage arising from the 3M PRODUCTS, whether direct, indirect, special, incidental or consequential, regardless of the legal theory asserted, including warranty, contract, negligence or strict liability. Controlling LawsThis Agreement will be construed and interpreted in accordance with the laws of the State of Delaware. Entire AgreementThis Agreement constitutes the entire agreement between the parties relating to the subject matter of the Agreement and supersedes all prior agreements, whether written or oral and all other communications between the parties relating to the subject matter of this Agreement. Modification of AgreementThis Agreement may not be changed except by a written agreement signed by an authorized officer of 3M. Acceptance of Agreement by BUYERBUYER accepts the terms and conditions of this Agreement by clicking the “I Accept” option during the checkout process. | ||||||||||||||||||||||||||||||||||||||
